Small Claims Court Issues / Representing Yourself

What is this?

Resources and assistance to help if you are filing a suit against someone, or are defending a suit filed against you, in small claims court.

Examples:

  • You want an attorney to help you prepare for a small claims issue, which you are the "plaintiff" (you are filing the case.)
  • You want an attorney to accompany you in small claims court matter, where you are the "defendant" (someone has filed a case against you.)

For Contingency Arrangements

There may be a situation where you and the network attorney agree to handle your legal matter with a contingency fee arrangement. This means that if you win the case, the attorney’s fees will be deducted from any money awarded to you.

Under the ARAG legal plan, the contingent fee cannot exceed 25% of the net recovery if successfully resolved before trial, or will not exceed 33% of the net recovery if successfully resolved after trial, or will not exceed 40% of the net recovery if successfully resolved on or after an appeal. You and the network attorney will arrange how costs (such as court costs, filing fees, etc.) incurred while pursuing your legal matter will be handled.
